Taxes in Albania for Foreign Residents

Becoming an Albanian resident changes your tax position — sometimes dramatically for the better. Understand the framework before you move.

Albania's tax system is one of its attractions: competitive personal income tax rates, favourable treatment of some foreign income, and a growing network of double-taxation treaties. But tax residency rules apply to you whether you plan for them or not. This hub explains the framework and links to the detailed guides.

When you become an Albanian tax resident

You become an Albanian tax resident when you spend more than 183 days in Albania in any 12-month period, or when your centre of vital interests is there. Tax residency means Albania taxes your worldwide income — not just what you earn locally.

There is a third trigger that almost nobody warns about: the permanent-home rule. If you have a permanent home available in Albania — and a registered lease of 12 months or more, with your address registered at the local municipality (bashkia), fits that description — tax residency can apply from day one, with no day-counting at all. This is the quiet trap for permit holders: the very documents that win you the permit (a 12-month notarised lease) can make you tax resident on arrival. Model your position before you sign, not after.

Personal income tax in Albania

The personal tax architecture, under the current income tax law (Law 29/2023):

  • Employment income: progressive rates of 13% and 23% above the exempt band.
  • Dividends: 8%. Capital gains: 15%.
  • Self-employment / freelance business income: 0% on annual turnover up to ALL 14 million (≈ €140,000), a regime confirmed until 31 December 2029 — after which practitioners expect a return to 15% unless the law changes again.
  • Social contributions for a registered self-employed person run around ALL 14,900 per month even when income tax is zero.

Tax resident individuals file an annual personal income declaration; residency, not citizenship, drives the obligation.

Double taxation treaties

Albania has double-taxation treaties with much of Europe — including the United Kingdom and Italy — and with partners such as the UAE. Treaties typically allocate taxing rights between the two states and give relief through an exemption or a credit method.

The glaring exception: there is no Albania-United States tax treaty, and no social security totalization agreement. For Americans this means double filing with no treaty tie-breaker: the US taxes its citizens on worldwide income regardless of residence, Albania taxes its residents on worldwide income, and the only reconciliation happens on the US return through the Foreign Tax Credit (the Foreign Earned Income Exclusion, note, does not cover pensions). As one US resident summarised: "Albania does not have a tax treaty with the US. [...] If you stay over 183 days, you are a tax resident, paying tax ON WORLDWIDE INCOME. That means SS, Roth, IRA, etc."

Special situations

Two profiles need their own deep dive:

  • Retirees drawing a foreign pension. Albania does exempt foreign pensions from personal income tax — but the exemption is restricted to EU/EEA citizens and people of Albanian origin. A final word on the "nobody cares" theory you will hear in expat bars — "you can get by without paying taxes as nobody cares". Enforcement is a separate question from law, and even sceptical residents concede that "with things becoming more and more digital in Albania I don't see how this can not be an increasing concern." Unreported tax residency is a debt that accrues quietly and surfaces at the worst moment: a renewal, a property purchase, a bank compliance review.
