Americans are among the fastest-growing groups of foreign residents in Albania, helped by the unique 365-day visa-free stay. When you are ready to settle properly — work, bank, healthcare, long-term leases — a residence permit is the next step. This guide is written specifically for US citizens.
Your entry advantage: one year visa-free
Under Circular no. 124/2022 — reconfirmed by Joint Instruction no. 91 of April 2026 — Americans can stay in Albania visa-free for up to 365 days. Most nationalities get 90 days. Unofficial estimates put US residents in Albania anywhere between 3,000 and 15,000 — yet only 1,128 held a permit at the end of 2025 (FER data), even as new US applications grew 164% year on year. If you plan to stay, bank, lease or work properly, you will eventually need the permit.
Choosing your permit route
The route depends on your profile:
- Retired? The pensioner permit (Art. 85, Law 79/2021) requires a pension of at least 1,200,000 ALL/year (~$15,100). In practice Albanian officials look for a public pension — Social Security, VA or Railroad Retirement qualify; private annuities and 401(k) drawdowns are a gray area, so get written confirmation before relying on them. - Employed locally or buying a home? Employer-sponsored Unique Permit (work permit) or the property owner permit (Art. 84 route).
One US-only perk worth knowing: Americans (like EU citizens) can receive a five-year permit at first issuance instead of the standard one-year card — fewer renewals, less paperwork.
US-specific document issues
The criminal-record step is where American applications most often stall. Albania requires the FBI Identity History Summary — a federal check, not a state police certificate — apostilled by the US Department of State Office of Authentications. Budget 4–8 weeks for this step alone. Three classic mistakes: ordering a state check instead of the FBI report; getting a state apostille for a federal document (wrong authority — it will be rejected); translating the document before the apostille, which means redoing both. There is also a lesser-known workaround used by some applicants in Tirana: the US Embassy issues a notarized Affidavit of Eligibility (~$50, valid 90 days) in which you swear your record is clean. Some applicants report it was accepted for both one-year and five-year permits. It is not guaranteed for every category — confirm with the migration office or your lawyer before relying on it.
US tax obligations while living in Albania
Read this section twice — it is the part most relocation blogs get wrong, and the mistake costs real money.
Albania does exempt foreign pensions from income tax. But under the current law (Law 29/2023) that exemption applies only to EU/EEA citizens and people of Albanian origin. A US citizen without Albanian origin does not qualify, as Tirana tax advisers confirm. And there is no US–Albania income tax treaty and no Social Security totalization agreement.
What that means in practice: once you become an Albanian tax resident — more than 183 days, or simply by registering a "permanent home" — Albania taxes your worldwide income at 0–23%, and your US filing obligations (Form 1040, FBAR, FATCA) continue unchanged. The Foreign Earned Income Exclusion does not cover pensions. Sites repeating "pensioni estere tax-free" without the EU restriction are recycling marketing, not law.
